BWScan, LLC. ("BWScan" or "We") provides products and services in 2d barcode space and mobile sites ("Services"). We reserve the right, at our sole discretion, to change, modify, update, add, or remove portions of the Terms of Use at any time, with or without notice to you. Please check these Terms of Use periodically for changes. Your use of the Services means that you have accepted these Terms of Use. Your continued use of Services after any changes in Terms of Use means you have accepted all those changes to date. You also understand that we may at any time at our sole discretion modify, suspend or discontinue the availability of the Service, with or without notice at any time.

Limitation of Liability. You understand that the Services are made available "as is". We make no warranties, express, implied, statutory, or otherwise with respect to the Services, including non-infringement and the implied warranties of merchantability and fitness for a particular purpose. The Services may contain technical inaccuracies or errors. We assume no responsibility for and disclaims all liability for any such inaccuracies, errors, or omissions on the Services. Under no circumstances shall BWScan be liable for any indirect, direct, special, punitive, incidental, consequential damages, lost profits or business interruption arising out of use or inability to use our Services. If any state or other jurisdiction does not allow the exclusion or limitation of liability for damages, then our liability shall be limited in those jurisdictions to the extent permitted by law.

Use of Services. All messages, information, digital files or other materials, whether publicly posted, displayed or performed on, or privately transmitted, are the sole responsibility of the person who sends or publishes such items. You are responsible for all items that you message, post and/or link to via our Services. By using our Services, you may incur additional fees from the use of mobile and/or Internet services of your network or other telecommunications or other service provider. We assume no responsibility for the payment of such fees.

Prohibited Activities. You must not modify, decompile, or reverse engineer any our Services, and you must not remove or modify any copyright or trademark notice, or other notice of ownership. You agree that you will not use our Services to:

5. disrupt our Services in a manner that negatively affects other users' ability to use the Services;

7. create user accounts using any automated means.

We do not control such web sites and are not responsible for their contents or actions.
